Helium is a brand of Oxpecker Technology Pvt. Ltd., a company registered in India, based in Janakpuri, New Delhi, India. Contact: hello@gethelium.co.

By using gethelium.co, placing an order or installing our app you agree to these terms, our privacy policy, our refund and cancellation policy and our cookie policy. If you accept for a company, you confirm you may bind it.

Helium makes content for brands, including product images, ad creatives, UGC-style and creator videos, founder content and launch pages, and can manage advertising. The scope, volume and timelines for your plan are set out in your proposal or order form.

Free samples are made at our discretion, one per brand unless we agree otherwise. You may use a sample to evaluate our work. Commercial use of a sample requires a paid plan.

• Monthly plans are billed in advance and renew each month until cancelled. Quarterly plans are billed in advance for the quarter.
• Trials and test batches are one-time payments. In India, the trial fee is credited to your first month if you continue.
• Prices for India are in rupees and exclusive of GST and other applicable taxes, which are added to the invoice. International prices are in US dollars.
• Ad spend is paid by you directly to the ad platforms and is separate from our fees.
• Invoices are payable within 7 days by bank transfer, UPI or card (through Razorpay or Stripe). We may pause work while an invoice is overdue.

Plans run month to month. You can cancel before your next billing date and the plan ends at the end of the current paid period. Fees already paid are not refundable unless we agree otherwise in writing or our refund and cancellation policy says so.

You confirm that you have the rights to the products, logos, images, footage and other material you send us, and that we may use them to make content for you.

Once paid for, you get full commercial rights to the final content we deliver for your brand, under an exclusive licence where ownership cannot transfer by law. We may keep internal copies and, with your permission, show the work in our portfolio.

Some content is made with AI. We disclose AI-made content where platforms or laws require it and we do not create fake customer testimonials. You are responsible for how and where you publish the content, including any claims you make about your products.

Where we manage your ads, we work inside ad accounts you own. We aim to improve results but cannot guarantee specific outcomes, since results depend on your product, offer, budget and the platforms.

Our app, Helium AI: Analytics & CRO, is installed from the Shopify App Store. For the app:

• Plans and billing. The Free plan and paid plans are listed on the App Store listing. Paid plans include a 7-day free trial and are billed by Shopify in USD every 30 days, together with any usage-based charges, under Shopify's terms.
• Cancelling. Uninstall the app or switch to the Free plan in your Shopify admin. Charges stop from the next billing cycle. Refunds are covered in our refund and cancellation policy.
• Your store and your shoppers. You stay responsible for your store, your products, your prices and your privacy notice and consent to shoppers. Changes the app makes (for example collection order, recommendations, product edits or feed labels) are made on your instruction; review them before you rely on them.
• AI output. AI agents and suggestions can be wrong. Check important answers and edits.
• Data. How the app uses store data is set out in our privacy policy.
• Availability. We work to keep the app running but don't promise it will be uninterrupted or error-free, and we may change or remove features.

You agree not to ask us to make content that is unlawful, misleading, infringing or harmful, and not to misuse the website or app (for example by scraping it, probing its security or interfering with other users). We may decline or stop work, or suspend access, if these terms are broken.

To the extent the law allows, our total liability for any claim is limited to the fees you paid us in the three months before the claim, and we are not liable for indirect or consequential losses, including lost profits. Nothing in these terms limits liability that cannot be limited by law.

These terms are governed by the laws of India, and the courts at New Delhi have exclusive jurisdiction over any dispute.

We may update these terms; the date at the top shows when they last changed. Material changes for active clients and app merchants will be notified by email or in the app. Questions: hello@gethelium.co.
